Introduction
These Terms and Conditions ("Terms") govern your access to and use of the services provided by SUNX Solar Energy Solutions ("SUNX", "we", "our", or "us"), including our mobile application, web platform, solar installation services, energy assessments, and related offerings.
By accessing or using our services, creating an account, submitting an installation request, or signing a solar package agreement, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
These Terms supplement our Privacy Policy. In the event of any conflict, the specific solar package agreement (contract) you sign with us will take precedence for matters related to your installation.

Our Services
We provide the following services (collectively, the "Services"):

All installations are subject to a separate solar package agreement that details the specific system, pricing, timeline, warranties, and obligations.

You must be at least 18 years old and legally capable of entering into contracts in Ghana to use our Services.
To use certain features, you must create an account. You agree to:

- • Maintain the confidentiality of your account credentials
- • Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
Solar Package Agreements (Contracts)
When you select a solar package, we will prepare a formal solar package agreement. You may review and sign the agreement digitally within the app. The agreement becomes binding once signed by both parties and any required deposit or initial payment is received.
Key contract elements include:

- • Payment terms and schedule

- • Performance expectations and any guarantees
- • Warranties on equipment and workmanship
- • Responsibilities for permits, grid interconnection (if applicable), and site preparation
Payments & Pricing
- • All prices are quoted in Ghana Cedis (GHS) unless otherwise stated and are subject to applicable taxes
- • Payment schedules are outlined in the solar package agreement (e.g., deposit, progress payments, final payment upon completion)
- • We accept payments via approved methods within the app or as specified in the contract
- • Late payments may incur interest or delay installation
- • Pricing is fixed once a contract is signed, except for agreed change orders
- • Refunds or cancellations are subject to the terms in your specific solar package agreement and applicable Ghanaian law
Installation & Site Access
You agree to:
- • Provide safe and reasonable access to your property for site surveys, installation, and follow-up work
- • Ensure the installation site meets basic requirements (e.g., suitable roof/structure condition, clear access)
- • Obtain any necessary permissions from landlords, homeowners' associations, or relevant authorities
We will perform installations professionally and in compliance with applicable standards and Ghanaian regulations. Installation timelines areestimates and may be affected by weather, permitting, supply chain issues, or other factors beyond our reasonable control.
Warranties & Guarantees
Equipment Warranty:
- • Solar panels, inverters, and other components carry manufacturer warranties (details provided in the contract)
Workmanship Warranty:
- • We provide a workmanship warranty for installation (typically 5–10 years; exact period stated in your contract)
Warranties do not cover:
- • Damage from misuse or unauthorized modifications
- • Extreme weather events not covered by insurance
- • Failure to perform recommended maintenance
- • Existing electrical systems or structures unless explicitly stated

- • Notifying us promptly of any issues with the system
Limitations of Liability
To the fullest extent permitted by law:
- • SUNX is not liable for indirect, incidental, consequential, or punitive damages (including lost profits or energy savings)
- • Our total liability for any claim shall not exceed the amount you paid for the specific solar package
- • We are not responsible for delays or failures caused by events beyond our reasonable control (force majeure), including weather, strikes, supply shortages, or government actions
Termination & Suspension
We may suspend or terminate your access if:
- • You breach these Terms or the solar package agreement

- • We determine the installation cannot proceed safely or legally
If you cancel before installation begins:
- • Cancellation is subject to the policy in your contract, which may include forfeiture of deposits or payment for work already performed
